RICO (18 U.S.C. 1961 et seq.) was enacted in 1970 as part of the Organized Crime Control Act. Originally aimed at organized crime, it has since been applied broadly to any group engaged in a pattern of qualifying criminal activity. Understanding what the government must establish helps explain both the breadth of these charges and where defenses can take hold.

To obtain a RICO conviction, federal prosecutors must prove five elements beyond a reasonable doubt:

An enterprise exists: Any individual, partnership, corporation, association, or group of individuals associated in fact. The enterprise doesn’t have to resemble traditional organized crime.
The enterprise affects interstate or foreign commerce: Even a minimal connection to interstate commerce is sufficient under federal case law.
The defendant is employed by or associated with the enterprise: The connection can be formal or informal.
