Appeals Attorney in Louisville

State & Federal Appellate Experience for Kentucky Criminal Cases

Criminal appeals require counsel who can identify reviewable legal errors in an existing record and present them under strict procedural rules. At The Simon Law Office, we represent people seeking to challenge criminal convictions, sentences, and post-conviction rulings in Louisville and Jefferson County, Kentucky. Larry Simon has defended people charged with criminal offenses at trial and on appeal in state and federal courts.

Larry Simon is admitted to practice in all Kentucky trial and appellate courts. His five years as a felony court prosecutor in the Jefferson County Commonwealth Attorney’s office provide relevant perspective when reviewing criminal proceedings and the records created in them.

The Kentucky Criminal Appeal Process

The process begins in the court that entered the decision being appealed. It then moves through preparation of the appellate record and written briefing.

The principal stages generally include:

  • Notice of appeal: Under the Kentucky Rules of Appellate Procedure, the notice generally must be filed with the trial court clerk within 30 days after notation of service of the judgment or order being appealed.
  • Jurisdictional deadline: The notice deadline is jurisdictional, meaning a late filing can deprive the appellate court of authority to hear the appeal.
  • Appellate record: The record from the original proceedings is prepared and certified after the appeal begins.
  • Appellant’s brief: The appellant, or party bringing the appeal, generally has 60 days to file a brief explaining the claimed errors and requested relief.
  • Commonwealth’s response: After receiving that brief, the Commonwealth, which represents the prosecution, generally has 60 days to submit its response brief.

These stages don’t establish a fixed overall timeline. Record preparation, briefing schedules, the issues presented, and court orders can affect how long an appeal takes. Prompt review is important because the first filing deadline is tied to the appealed decision, not to when a person begins looking for counsel.
